These Terms of Use (“Terms”) govern your use of the Brown Noise for Sleep app and website (the “Service”), published by IT Deve Apps. By downloading or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

License

We grant you a personal, non‑exclusive, non‑transferable, revocable license to use the app for your own non‑commercial use, subject to these Terms and to Apple’s Standard End User License Agreement (EULA), which applies to apps downloaded from the App Store.

Health disclaimer

Brown Noise for Sleep provides audio for relaxation, focus, and sleep. It is not a medical device and does not diagnose, treat, cure, or prevent any condition, including tinnitus or any sleep disorder. The Service is not a substitute for professional medical advice. Consult a qualified healthcare provider for any medical concern. To protect your hearing, do not listen at high volume for prolonged periods.

Subscriptions and purchases

The app offers an auto‑renewable subscription and may offer one‑time (lifetime) purchases that unlock premium features. The following terms apply to auto‑renewable subscriptions:

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews at the then‑current price unless it is cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription, and turn off auto‑renewal, in your device’s Settings → Apple ID → Subscriptions at any time.
• Prices are shown in the app and may vary by region; any free‑trial period (if offered) ends if you purchase a subscription, and the unused portion of a trial is forfeited when you buy a subscription.

Purchases are processed by Apple. Refunds are handled by Apple in accordance with the App Store’s policies; request a refund at reportaproblem.apple.com. You can restore a previous purchase at any time from within the app.

Acceptable use

You agree not to reverse engineer, redistribute, resell, or attempt to extract the audio content or source of the app, except where such restriction is prohibited by law.

Intellectual property

The app, its audio content, artwork, and branding are owned by IT Deve Apps and protected by applicable intellectual‑property laws. These Terms do not grant you any rights to our trademarks or content beyond the license above.

Disclaimer of warranties & limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
